This regulatory shift allows the U.S. Food and Drug Administration (FDA) to gain new insights into the multitude of products and their production locations within the U.S. beauty market. Additionally, MoCRA grants the FDA authority over aspects such as mandatory product recalls and warnings about allergen-inducing ingredients. Originally scheduled for full implementation on December 29, 2023, the FDA recently announced a six-month delay in the enforcement of certain provisions, garnering industry attention.A pivotal aspect of MoCRA is the extension of the deadline for facility and product registrations to July 1, 2024, providing additional time for the industry to prepare for regulatory compliance. While this extension is welcomed by those navigating the complex landscape of MoCRA, it does not alleviate concerns entirely. Only the deadlines for facility and product registrations have been extended, leaving other regulations within MoCRA unaffected as of the original December 29, 2023 deadline.MoCRA, a significant expansion of the FDA's regulatory authority over cosmetics, is the first of its kind since the passage of the Federal Food, Drug, and Cosmetic Act in 1938. While the majority of cosmetic industry entities welcome MoCRA as a necessary enhancement of regulatory oversight, there is notable confusion within the industry due to the lack of clear guidelines and representative compliance cases.The voluntary nature of the previous FDA program, the Voluntary Cosmetic Registration Program (VCRP), allowed companies to operate without mandatory registration. However, ongoing consumer dissatisfaction and cases of harm related to cosmetic safety prompted the need for stronger regulations. The emergence of the "Clean Beauty" market, emphasizing safer ingredients, further highlighted the necessity for a regulatory update.Despite the overall positive industry reception, uncertainties persist, especially among smaller brands and manufacturers. The central point of contention revolves around products designed for eye makeup. While MoCRA includes exemptions for certain conditions, such as businesses with an average annual cosmetic sales of less than $1 million over the past three years, the criteria for exemptions are causing confusion. Particularly, the ambiguity surrounding whether the exemption applies only to products directly contacting the mucous membrane of the eye or extends to traditional eye makeup products like mascara, eyeliner, and eyeshadow is a significant concern.In conclusion, the 6-month extension in the deadline for facility and product registrations provides a welcome respite for the industry to prepare for compliance with MoCRA. However, the overall uncertainty persists, especially regarding regulations beyond registration, and businesses are advised to stay vigilant and prepare for the originally scheduled deadline of December 29, 2023.

The Ministry of Food and Drug Safety designates 1,2,4-trihydroxybenzene as a prohibited ingredient in cosmetics.The Ministry of Food and Drug Safety (Minister Oh Yoo-kyung) revised the ‘Regulations on Cosmetic Safety Standards, etc.’ and designated 1,2,4-trihydroxy benzene (THB) as a prohibited ingredient in cosmetics. and announced that it would be added to the banned list.This is a measure based on the results of THB's safety verification. The verification was conducted by the Cosmetics Raw Material Safety Verification Committee operated by the Korea Consumer Organization Council. The Regulatory Reform Committee recommended verification of the safety of THB on March 25 last year.▲ Modamoda Black Shampoo containing 1,2,4-trihydroxybenzene (THB). The Ministry of Food and Drug Safety designates THB as a prohibited ingredient in cosmetics.The Cosmetics Raw Material Safety Verification Committee is comprised of experts in skin, toxicity, law, and media. Products manufactured before the revision can be sold until October 1, 2024.The Korea Consumer Organization Council said, “To evaluate the safety of THB, we comprehensively reviewed the SCCS (European Scientific Committee for Consumer Safety), the EU report, the Ministry of Food and Drug Safety risk assessment report, and data submitted by related companies. “We concluded that THB has the potential to be genotoxic,” he explained.He continued, “There is no threshold for THB due to its genotoxic potential, so the toxicity standard cannot be determined. It is impossible to set safety standards for human exposure to THB. There are concerns about safety if consumers continue to use it. “It is reasonable to prevent the use of THB as a cosmetic ingredient as a preventive measure,” he said.The Korea Consumer Organization Council recommended that Modamoda prepare a voluntary recovery plan, such as recalling products containing THB. He said that compensation measures should be prepared for consumers who have suffered side effects from the product.In response to this, Modamoda has not yet announced a recall or refund plan for black shampoo. The company emphasized through a pop-up window and notice on its official website on December 6 that ‘Zero Gray Black Shampoo’, which was released in October, and not black shampoo, was a product that complied with the Cosmetics Act.Modamoda said, “Zero Gray Black Shampoo is a product that complies with the standards set by the Cosmetic Act. “It did not contain 12 types, including 1,2,4-trihydroxybenzene and o-aminophenol.”
